1. Definitions
1.1 Defined Terms. For purposes of this Agreement:
♦ Agreement means these Terms of Service and any applicable rate sheet or session offering.
♦ Client means the individual or entity booking the Services.
♦ Images means all photographs and digital files created by Photographer in connection with the Services.
♦ Raw Files means unprocessed digital files captured directly from the camera sensor.
♦ Proofs means intermediate images provided to Client for selection or review purposes prior to final editing. Proofs are works in progress and do not constitute deliverables.
♦ Returned Images means the final edited photographs delivered to Client as high-resolution JPEG files. Only Returned Images constitute deliverables.
♦ Services means the photography services as described in the applicable session offering or as otherwise agreed in writing.
♦ Photographer means Jay Annadurai Photography and its authorized agents or subcontractors.
♦ Session means the scheduled photography appointment.
♦ Mini Session means a pre-scheduled appointment in consecutive time slots at a predetermined location, with modified terms. Where this Agreement specifies different terms for Mini Sessions, those modified terms supersede the general provisions.
♦ Retainer means the non-refundable advance payment required to reserve a Session date.
♦ Editing means standard post-processing including exposure, brightness, color, contrast, cropping, and tonal adjustments. Editing is included in all Services.
♦ Retouching means advanced digital modification including blemish removal, feature modification, or object removal. Retouching is NOT included and is not guaranteed.
2. Photographer Responsibilities
2.1 Equipment and Performance Standards. Photographer shall provide all equipment and perform Services in a professional manner consistent with industry standards for portrait photography.
2.2 Artistic Consistency. Services will be produced in a style consistent with Photographer's portfolio. Photographer will consider Client preferences while retaining final artistic discretion.
2.3 Communication. Photographer will maintain reasonable communication through Client's preferred channel. Formal communications sent via email for record-keeping. Photography is not Photographer's full-time occupation; availability may be subject to academic and professional schedule.
2.4 Service Exclusions. Photographer is not responsible for wardrobe, makeup, styling, or props unless explicitly included in the session offering.
2.5 Insurance Disclosure. Photographer does not carry commercial liability insurance at this time. Client must verify venue insurance requirements prior to booking. If Client-selected location requires insurance not disclosed prior to booking, Client forfeits retainer.
2.6 Photographer-Selected Locations. When Photographer selects the location, Photographer confirms general suitability. If location proves unsuitable, Photographer offers reschedule or prorated refund at Client's election.
2.7 Right to Decline Locations. Photographer may decline any location determined to be illegal, unsafe, inaccessible, or unsuitable.

2. Session Logistics
Confirmation & Rescheduling Policy
♦ Session Time & Location must be agreed upon in advance
♦ Session must be confirmed 1~2 hours prior to Session start
♦ If confirmation is not received, I reserve the right to cancel

♦ Rescheduling is allowed with at least 24 hours' notice*
Travel & Location Policy
♦ Travel is calculated from Eagle's Nest, Zionsville, IN
♦ Locations requiring 10+ miles one-way travel may incur a fee

Lateness Policy
♦ If the Client is late, session duration is accordingly shortened
♦ If I (the Photographer) am late, time is extended or credited
♦ If 20 minutes pass, session is considered a no-show***

Session Execution
♦ I do not provide outfits, makeup, or props unless noted
♦ Sessions will always begin with introductions
♦ Shooting time is estimated at half of the session time****
♦ I reserve the right to take a small review session and break
*Rescheduling within 24 hours may be granted in emergency
**Environmental issues will be handled on a case-by-case basis
***No-shows are considered a forfeit of any applicable deposits

3. Session Payment
Payment Policy
♦ Full payment is accepted via Cash or Zelle at Session start
♦ I reserve the right to request a deposit before the session*
♦ Deposits are typically $20 or 50% of the session fee
Potential Additional Fees
♦ Travel Fee may apply for travel beyond 10 miles one way
♦ Editing Fee may apply if client requests more than 20 images

Refund & Credit Policy

4. Images & Usage
Image Format
♦ Final files are delivered as high-resolution, edited JPEGs
♦ PNGs and alternate formats are available on request
♦ RAW files are not provided except if technical issues arise*

Image Style
♦ All edits are performed in my personal photographic style
♦ Specific style requests are considered but not guaranteed

Image Delivery
♦ Delivery typically occurs within 1–2 weeks of the session
♦ In rare cases, delivery may take up to 1 month**

♦ Watermarks are removed for final images of paid sessions
♦ Images are archived and guaranteed for at least 180 days
Image Rights
♦ I retain full copyright to all images created during sessions

5. Privacy Policy
Image Sharing Policy
♦ All sessions and produced images are private* by default
♦ I will not publish any images without clients' explicit consent**
♦ I may request permission to share images from a session***
♦ With any sharing request, I will ask for a model release
♦ A private release authorizes sharing with others in private
♦ A public release authorizes public sharing, e.g. Social Media
Data Security Policy
♦ All image data is encrypted and stored on private systems
♦ Private cloud services are used for delivery and backup
♦ Download links and galleries are access-controlled
♦ All collected personal information is solefor record-keeping
Exceptions & Portfolio Sessions
♦ Free Sessions or Portfolio Sessions may innately be shared
♦ I reserve the right to publish images without further consent
♦ As a courtesy, I may still inform you before sharing***
